Two Years Battling Goliath

Two years ago (September 2014) I received a Google Alert.

No big deal, right?

I keep them to make sure I know what’s being said about what I do and my industry. But this time it was different. It was a Friday night. And I saw it right there in my face. Someone was using Women Are Gamechangers as the name of their organization. It sent me into a frenzy. I was so frustrated. I called the advisors for WAGC as well as an attorney. All I could think was how dare someone use what I created and tried to make money from it? Not even a couple weeks later, someone else decided to use the name of my company for their event. Then I filled for a trademark.

But here’s the thing.

I didn’t have the money.

I found the money.

We do that, right?

We do that whenever it’s necessary.

And this was so necessary.

After two years going back and forth with the USPTO office i.e. Goliath over every detail they didn’t like in the application, proving I owned the name and logo, having to find the old logo to show that I changed it and lots of miscommunication I received final notice that the trademark was mine.

Great!

Nope.

Not at all.

The name was not the way it was on the initial application. So here I was still battling Goliath over a name I created in 2011 when I realized that returning to full time teaching wasn’t going to happen. After a few emails and phone calls, it has been fixed. The trademark is what my attorney and I originally filled.

Here’s what I want you to takeaway from this situation (the abbreviated version). I want you to know that if it’s truly yours,

NEVER STOP FIGHTING FOR IT.
